About the Service 

Beo Clinical Psychology is a clinical psychology service that specialises in trauma and adversity providing psychological therapy for a range of trauma related mental health difficulties for people across the lifespan, from childhood into older adulthood. 

How Beo Clinical Psychology protects and manages your personal data

To deliver services at Beo certain personal data is collected and held. In collecting and holding your data we are committed to protecting and respecting your privacy. This policy documents how we comply with data protection legislation with General Data Protection Regulation (GDPR) and current Data Protection Legislation (the Data Protection Acts of 1998 and 2003). The policy also states how personal data that you provide will be used. This policy applies to prospective clients, clients, and referral sources (e.g. GPs, insurers and partners)

How Beo Clinical Psychology obtains personal information

If you contact the service by telephone or email a record of that contact may be kept. Records of any meetings or sessions will be collected and held in the form of written or electronic notes. Correspondence or reports from you or from other healthcare professionals relating to you will be kept, if received. 

Given the nature of this service, your information will fall into two categories, Personal Data and Special Category Data. Explicit written consent is needed for Special Category Data to be collected and kept. You will be asked to give explicit written consent for yourself or your child, if under 18 year old, ahead of commencing assessment or treatment at Beo. 

Personal Data

Your personal data includes the following: 

  • Your full name 
  • Your date of birth
  • Your address
  • Your telephone number
  • Your email address 

If your child is the primary client, in addition to the information above we also collect the same aforementioned information for any other legal guardians in their care. The following contact information specifically related to your child is needed: 

  • Your child’s full name 
  • Your   child’s date of birth
  • All addresses where your child resides 

General Information. In order to provide you a service we also hold general information that you may have provided. Some of this information ensure legal and regulatory obligations are fulfilled. The information may include the following: 

  • Details about who referred you/your child (e.g. GP, CAMHS, self-referral)
  • A record of appointment dates, location, type (assessment or therapy), attendance and cancellations (including administrative correspondence related to same)

Wider family details. To ensure that adequate health and safety arrangements can be made if required , you will be asked to provide details of a next to kin. Consent may be required from a parent/guardian to commence therapy, and such contact and general information will be collected and held. Contact and general information about other family members who are directly or indirectly involved in your work may be collected and stored. 

Special Category Data 

As Beo Clinical Psychology provides psychological assessment and therapy, service data relating to your physical and mental health is collected. According to the General Data Protection Regulations, all data on health is special category data. To provide a comprehensive service to you, data of this nature is collected. We only collect and hold data that is relevant to your treatment. Your consent is sought for this type of data to be collected and processed. 

Special Category Data includes: 

  • The name and contact details of your GP and other health professionals involved in your or your child’s care
  • Details of your child’s school/college, if needed
  • Your reason for contacting the service 
  • Details pertaining to  you or your child’s physical and mental health
  • Medication being prescribed/taken
  • The nature of the therapeutic service being offered to you
  • Correspondence from or to you about you/your child’s treatment at Beo
  • Correspondence from or to other health care professionals or educational institiutions about your treatment at Beo Clinical Psychology
  • Writing, drawing or photos of same that have been created or used in the therapeutic process
  • Session notes 
  • Completed consent forms

Payment information

Information on payments made to Beo Clinical Psychology are collected and held for financial records. Such information may include: 

  • Your full name 
  • The date and amount of the transaction
  • Where a payment is made by another party for you, details of the payee will be kept. 

Who is your data shared with?

Only Dr Claire O’Driscoll-Lawrie has access to your data. Your data will not be shared with any commercial organisation under any circumstances.

We may share your data with trusted third parties, including:

Legal, safeguarding, or emergency services – where required by law or to protect safety. Special Category data may need to be shared with other professionals in your care network, however, you will be made aware of such circumstances and we will work together on how best to share such information.

Supervisors –Dr Claire O’Driscoll Lawrie receives formal supervision with a qualified healthcare professional for her clinical work. Anonymised details of your work with her may be shared with her supervisor to support effective work with you. Any sharing of information for supervision purposes will adhere to the terms of confidentiality. 

Practice Management & IT Systems – WriteUpp (client notes), Zoom (online sessions), Xero (accounting), Word press (website hosting)

Referral Partners – where you have been referred via a GP, insurer, or partner organisation.

Where is your data stored? 

Your digital data is story on our secure GDPR complaint software WriteUpp. Dr Claire O’Driscoll-Lawrie is the only person able to access your stored data on WriteUpp. Digital data includes your personal and special category data including assessment summaries, brief session notes, and correspondence. Where reports and letters are in progress on a laptop they will be encrypted, password protected and saved on password protected laptop. Once the document is finalised it will be uploaded onto WriteUpp and the copy saved on the laptop will be destroyed. 

Beo Clinical Psychology uses ProtonMail email provider, which is an encrypted email server. As you server may not be as secure, please do not send sensitive information via email. Any documents sent to you by email will be password protected. 

Contact made to Beo Clinical Psychology by telephone, email, website or text to make appointments will deleted after the appointment is made. Any physical materials such as questionnaires or assessments that are completed in person, are stored in a locked file cabinet. 

How long is your data stored at Beo Clinical Psychology?

Statutory and Regulatory legislations determine the length of time that your data will be stored. Currently, it is required that for adults your personal and special category data is permanently deleted after seven years after completing treatment. In the event of death by suicide of a client, data is stored for 10 years from death. For minors, the seven-year period commences when they turn 18 years old. A review of the time-frame for stored data and related data deletion occurs on an annual basis. 

Confidentiality

All sessions will be carried out in strict confidence. All clinical notes are kept to a minimum of headings and abbreviations as an aide memoire and information is not held longer than legally necessary ( see above). Confidentiality will be maintained for all our sessions and written/typed records except in the following instances:

  • Where the client consents for information to be shared with other agencies or health professionals involved in their care
  • Where the psychologist is compelled by a court of law
  • Where the psychologist concerned about the safety of the client or others being at risk of significant harm or death.

In all instances please be assured that I would always seek to speak to you first before sharing anything about you. Where relevant I may share a copy of your reports and/or letters sent to your GP or other parties involved in your care.

What happens if my data is lost or compromised? 

It is very unlikely that  data will be lost or compromised. If sensitive data is lost or compromised you will be informed that it has happened. The Office of the Data Protection Commissioner will also be informed. If devices or equipment containing personal data or sensitive data are lost or stolen, the Data Protection Commissioner is only informed if such data is not encrypted. Your data will always be encrypted.

What are my rights regarding my data? 

Under Data Protection Legislation you have the following rights: 

  • Subject Access: You have the right to see what information is held about you/your child at Beo Clinical Psychology.
  • Rectification: You have the right to request that many incorrect personal data held at Beo Clinical Psychology is corrected. 
  • Erasure: You have the right to ask us to erase information that is stored about you. Please not, that this right might be limited by statutory or regulatory requirement. 
  • Communications: You have the right to ask us not to contact you, however, while in treatment we will need to contact to you to provide the service you agreed to. The type of communication will be respected.

If you wish to exercise these rights please contact Dr Claire O’Driscoll-Lawrie. Please not that your subject access rights might be restricted by the following legislation.

Restrictions on Access to Medical Data and Social Work Data 

According to the Data Protection (Subject Access Modi�ication) (Health) Order 2000 (SI 2000/413), and the The Data Protection (Access Modi�ication) (Health) Regulations, 1989 (S.I. No. 82 of 1989 (S.I. No. 82 of 1989) personal and special category data should not be made available if the information could likely cause serious harm to the physical or mental health of the data subject. 

Information about Other Individuals 

When data contains information pertaining to a third party/another individual (e.g. sibling/friends etc), this information cannot be released without the consent of the third party (Section 4(4) Data Protection Act). However, data can be shared with identifying information removed. 

What if I would like my notes to be shared with my solicitor?

In the event that you give permission to a solicitor to access your clinical notes in for judicial preceding’s, I advise you to seek permission to view your notes in advance of them being sopenade by your or another’s legal council. If notes are sopenade after our therapy journey has ended I will contact you to inform you that this request has been made. 

Contact regarding data protection issues

Dr Claire O’Driscoll-Lawrie is the appointed Data Protection Officer (DPO). Her role as DPO is to ensure compliance with regulations and to liaise with any data related queries in a confidential manner.
